Welcome to NFCFind. These Terms & Conditions ("Terms") govern your access to and use of the NFCFind mobile applications, website, and related services (collectively, the "Service") operated by NFCFind ("we," "us," or "our").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

To use NFCFind, you must:

  • Be at least 13 years of age (or the minimum age required in your jurisdiction).
  • Provide accurate and complete registration information.
  • Have the legal capacity to enter into a binding agreement.

If you are using the Service on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.

2. Account Registration and Security

2.1 Account Creation

You must create an account to access most features of the Service. You agree to:

  • Provide truthful, accurate, and complete information during registration.
  • Keep your account credentials confidential.
  • Notify us immediately of any unauthorized access to your account.

2.2 Account Responsibility

You are solely responsible for all activity that occurs under your account, whether or not authorized by you. We are not liable for any loss or damage arising from unauthorized use of your account.

2.3 Account Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms, engage in fraudulent activity, or for any other reason at our sole discretion.

3. NFC Tags and Items

3.1 Tag Registration

  • NFC tags purchased from or registered on NFCFind are for use with the NFCFind Service.
  • Each tag has a unique identifier and can be linked to one item at a time.
  • You are responsible for the physical security and proper attachment of NFC tags to your items.

3.2 Tag Ownership

  • Tags registered to your account are associated with your user profile.
  • You may transfer tag ownership through the Service's transfer feature.
  • We are not responsible for tags that are lost, stolen, damaged, or become non-functional.

3.3 Item Information

  • You are responsible for the accuracy of item information (names, descriptions, photos, estimated values) you enter into the Service.
  • Do not use the Service to track items that belong to others without their consent.
  • Do not upload content that is illegal, defamatory, or violates the rights of others.

3.4 Tag Passwords

  • You may set a password on your NFC tags for additional protection.
  • You are responsible for remembering your tag passwords. We store passwords in hashed form and cannot recover them.

4. Lost & Found Features

4.1 Finder Contact System

  • When someone scans a tag linked to your item, they may be able to contact you through our secure messaging system.
  • Your actual contact details (phone number, email) are not directly shared with finders unless you configure your privacy settings to do so.
  • We do not guarantee that lost items will be recovered.

4.2 Finder Obligations

If you find an item with an NFCFind tag:

  • Use the contact system in good faith to help return the item.
  • Do not misuse the contact system to send spam, threats, or inappropriate messages.
  • Do not intentionally damage, remove, or tamper with NFC tags on items that do not belong to you.

4.3 Location Data

  • Scan locations are recorded to help item owners track and recover lost items.
  • This data is shared only with the item owner and is not publicly visible.

5. Lending and Borrowing

5.1 Lending Requests

  • You may lend items to other NFCFind users through the lending feature.
  • Lending arrangements (duration, conditions, due dates) are between the lender and borrower.
  • NFCFind facilitates lending management but is not a party to any lending agreement.

5.2 Responsibility

  • Lenders are responsible for ensuring they have the right to lend an item.
  • Borrowers are responsible for returning items in the condition they were received.
  • NFCFind is not liable for any loss, damage, or disputes arising from lending arrangements.

5.3 Overdue Items

  • The Service may send reminders for overdue items, but enforcement of return is the responsibility of the parties involved.

6. Ownership Transfers

6.1 Transfer Process

  • You may transfer ownership of items to other NFCFind users.
  • Transfers require acceptance by the recipient.
  • Once a transfer is completed, it cannot be automatically reversed.

6.2 Transfer Responsibility

  • You may only transfer items that you legally own.
  • NFCFind is not responsible for verifying the legal ownership of transferred items.
  • Fraudulent transfers may result in account suspension or termination.

7. Organizations

7.1 Organization Features

  • Users may create and manage organizations to share items and tags with team members.
  • Organization administrators can invite members, assign roles, and manage shared items.

7.2 Organization Roles

  • Owner: Full control over the organization, including deletion.
  • Admin: Can manage members, items, and tags within the organization.
  • Member: Can view and interact with shared items and tags.

7.3 Liability

  • Organization owners and administrators are responsible for managing access and permissions within their organizations.
  • NFCFind is not liable for any misuse of shared items or data within organizations.

8. Subscriptions and Payments

8.1 Plans

  • NFCFind offers free and paid subscription plans with varying feature limits (number of items, tags, organizations, etc.).
  • Plan details and pricing are available on our website and within the app.

8.2 Payment Processing

  • Payments are processed through PayPal. By subscribing to a paid plan, you agree to PayPal's terms of service.
  • Subscription fees are billed on a recurring basis (monthly or annually) as selected.

8.3 Cancellation and Refunds

  • You may cancel your subscription at any time through the app or website.
  • Upon cancellation, your paid features remain active until the end of the current billing period.
  • Refunds are handled in accordance with our refund policy and applicable law.

8.4 Plan Changes

  • We may modify plan features and pricing with reasonable notice.
  • Existing subscribers will be notified of changes before they take effect.
  • If you do not agree to changes, you may cancel your subscription before the changes apply.

9. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose or in violation of any applicable law.
  • Impersonate any person or entity, or falsely represent your affiliation.
  • Upload or transmit viruses, malware, or any harmful code.
  • Attempt to gain unauthorized access to the Service, other accounts, or our systems.
  • Interfere with or disrupt the Service or servers/networks connected to the Service.
  • Scrape, crawl, or use automated means to access the Service without our written consent.
  • Use the Service to stalk, harass, bully, or intimidate any person.
  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Remove, alter, or obscure any proprietary notices on the Service.
  • Use NFC tags for tracking persons without their explicit consent.
  • Submit false lost item reports or abuse the finder contact system.

10. Intellectual Property

10.1 Our Rights

  • The Service, including its design, code, features, logos, and content, is owned by NFCFind and protected by intellectual property laws.
  • "NFCFind" and our logo are trademarks of NFCFind. You may not use them without our prior written consent.

10.2 Your Content

  • You retain ownership of content you upload to the Service (item photos, descriptions, messages).
  • By uploading content, you grant NFCFind a non-exclusive, worldwide, royalty-free license to use, display, and process that content as necessary to provide the Service.
  • You represent that you have the right to upload any content you submit.

11. Disclaimers

11.1 "As Is" Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11.2 No Guarantee of Recovery

WE DO NOT GUARANTEE THAT LOST ITEMS WILL BE FOUND OR RETURNED. THE SERVICE FACILITATES COMMUNICATION BETWEEN ITEM OWNERS AND FINDERS BUT CANNOT ENSURE THE OUTCOME.

11.3 NFC Tag Functionality

WE DO NOT GUARANTEE THAT NFC TAGS WILL FUNCTION INDEFINITELY. TAGS MAY BE AFFECTED BY PHYSICAL DAMAGE, ENVIRONMENTAL CONDITIONS, OR DEVICE COMPATIBILITY ISSUES.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NFCFIND AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • YOUR USE OR INABILITY TO USE THE SERVICE.
  • ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN.
  • LOSS, THEFT, OR DAMAGE TO ANY ITEM, WHETHER OR NOT AN NFC TAG WAS ATTACHED.
  • ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE.
  • ANY DISPUTES BETWEEN USERS ARISING FROM LENDING, TRANSFERS, OR OTHER INTERACTIONS.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless NFCFind and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service.
  • Your violation of these Terms.
  • Your violation of any rights of a third party.
  • Any content you submit through the Service.

14. Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which NFCFind is incorporated, without regard to its conflict of law provisions.

14.2 Informal Resolution

Before filing any formal dispute, you agree to contact us at support@nfcfind.com to attempt to resolve the matter informally within 30 days.

14.3 Arbitration

Any dispute that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration association. The arbitration shall be conducted in the English language.

15. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

16. Changes to These Terms

We may revise these Terms from time to time. The updated version will be indicated by an updated "Last updated" date. Material changes will be communicated through the app, website, or email. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and NFCFind regarding the use of the Service and supersede all prior agreements and understandings.
